Terms of Sale & Use

The website sosnadiamonds.com and the SOSNA Diamonds brand are operated jointly by our two contracting entities:

The contracting entity for a given transaction is identified on the pro-forma invoice, purchase order or bespoke agreement. When contracting with the U.S. entity, these Terms are governed by Florida law. When contracting with the EU entity, these Terms are governed by Czech law. Consumer protections mandated by the buyer's country of habitual residence are preserved to the extent required by applicable law.

SOSNA Diamonds is a private luxury house dealing exclusively in certified natural gemstones and certified natural diamonds — including emerald, sapphire, ruby, tanzanite, spinel, Paraíba tourmaline, alexandrite and natural diamonds — together with finished and bespoke jewelry incorporating those stones. We do not deal in, source, offer, or otherwise handle laboratory-grown, synthetic, HPHT, CVD or treated-as-natural stones under any circumstances.

Independent laboratory reports (GIA, IGI, HRD, SSEF, Gübelin and equivalent) accompanying our stones certify natural origin and, where applicable, treatment history. A laboratory report is a document of scientific opinion, not a warranty of monetary value.

All content on the website — including catalog listings, indicative pricing and availability — is an invitation to treat and not a binding offer of sale. A binding contract is formed only when SOSNA Diamonds issues, and the buyer countersigns or fully settles, a written pro-forma invoice or purchase order identifying the specific stone or piece by reference number, price, currency, delivery terms and payment terms.

Displayed prices are exclusive of applicable sales tax, VAT, import duties, insurance, shipping and any bank or wire fees, which are added at invoicing according to the destination and Incoterms agreed. Currencies shown in the website switcher are indicative conversions; the invoice currency is the binding amount.

A stone may be placed on a written hold for a defined period (typically 48 hours; longer holds by written agreement). A hold is a courtesy and does not remove the stone from the offering. A firm reservation requires an approved deposit (typically 20–30 % of the invoice value) and, once accepted in writing, removes the stone from public availability.

Deposits on reserved stones are non-refundable, except where the stone materially fails to match its written description, the accompanying laboratory report is later revoked by the issuing laboratory, or applicable consumer law provides otherwise.

Accepted methods include international bank wire, escrow services approved in advance, and — for U.S. transactions — certified checks or ACH transfers. Cryptocurrency is not accepted. Title to any stone or piece passes to the buyer only upon receipt of cleared funds in the full invoice amount. Risk of loss transfers according to the Incoterm stated on the invoice (typically DAP or CIP with fully insured carriage).

SOSNA Diamonds operates a documented KYC/AML program consistent with FinCEN guidance for U.S. dealers in precious stones and with EU AMLD requirements for the Czech entity. For qualifying transactions we may request identity documentation, source-of-funds evidence and beneficial-ownership confirmation prior to shipment.

Cross-border shipments travel through insured specialist carriers (Malca-Amit, Brink's, Ferrari Group or equivalent). The buyer of record is the importer of record in the destination jurisdiction and is responsible for any import duties, VAT, GST, sales tax or other levies assessed at entry unless the invoice explicitly states DDP.

Rough and cut natural stones and finished jewelry are supplied with the full documentation trail required by the Kimberley Process (for diamonds), CITES (where applicable) and any origin declarations required by the destination.

Ready-made stones and jewelry purchased at a distance by an EU consumer are subject to the 14-day right of withdrawal set out in Directive 2011/83/EU, exercised in writing and followed by return of the item, unaltered and with its laboratory report and packaging, at the consumer's expense. Bespoke pieces, personalized commissions and stones sourced against a specific brief are excluded from the right of withdrawal to the extent permitted by law.

For U.S. buyers, we operate a five (5) business-day inspection window from documented receipt, during which a full refund of the stone price (less shipping, insurance and any bank fees) is available if the stone materially fails to match its written description. Bespoke commissions are non-returnable.

Every stone is delivered with an independent laboratory report from an internationally recognized laboratory. We warrant that the stone delivered corresponds to the report supplied. We do not warrant, and expressly exclude to the maximum extent permitted by law, any warranty as to future market value, resale price or investment return.

To the maximum extent permitted by applicable law, the aggregate liability of SOSNA Diamonds arising out of or in connection with any transaction is limited to the invoice value of the goods giving rise to the claim. We are not liable for indirect, consequential, incidental, punitive or exemplary damages, loss of profit, loss of opportunity, or loss of anticipated resale value. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, death or personal injury caused by negligence, and mandatory consumer protections.

All content on sosnadiamonds.com — including editorial text, photography, video, plate imagery, house typography, the SOSNA Diamonds wordmark and the SOSNA monogram — is protected by copyright, trademark and unfair-competition law. Reproduction, republication, framing or use for the training of machine-learning models is prohibited without prior written consent.

Personal data submitted through inquiry forms, private sourcing briefs and bespoke commissions is processed in accordance with our Privacy Notice, which forms part of these Terms.

Contracts with the U.S. entity are governed by the laws of the State of Florida and subject to the exclusive jurisdiction of the state and federal courts sitting in Miami-Dade County, Florida, without regard to conflict-of-law rules. Contracts with the EU entity are governed by the laws of the Czech Republic and subject to the exclusive jurisdiction of the competent courts of Prague. EU consumers may additionally rely on the online dispute resolution platform of the European Commission at ec.europa.eu/consumers/odr.
